Time to check NVC for updates on your status for those with 2004-2006 PDs

Dear members with PDs of 2004-2006,


There is news that one blogger that allegedly blogged about him being asked by the National Visa Center to send in his Ds-230 forms and accompanying documents.  He allegedly has a Oct. 31, 2006 Priority Date.  Said blogger is originally from the Philippines but currently a UK Citizen.  The cut-off dates for EB3 ROW and EB3 Phils. are usually the same.

Usually, NVC only asks for these documents to be sent in if they expect that case to be current soon and regardless if their asking it only for the first time or to re-send it for updates.  Traditionally, from what we have observed from the last 2-3 years if a case is expected to be current within 9-12 months, NVC starts to re-process things again.

I think there is nothing to loose if we contact NVC for updates on our status, specially for those with PDs of 2004 through 2006.  And it's important that we share any info on cases of re-processing by NVC as it will benefit everyone.  At the very least, we can dispel rumors.

Hello.

If the National Visa Center follows same old routine, like processing or asking for update of DS230 fromt applicants with forseeable PDs  of 9-12 months from getting current, then this gives us another glimpse of hope.

I personally would like to call NVC to inquire my status, later did I realize that my papers are no longer at the NVC level.  My papers were stucked at the Riyadh embassy way before the cut-off date stopped at May 2005.  

Like t-cell, I encourage everyone to start communicating with the National Visa Center especially for those nurses with earlier priority dates.  In this forum, I haven't encounter nurse-applicants with PDs of 2004 and earlier.  I've known a few though with PDs of 2005 to early 2006. 

If in any way there's something new with your status, please do not hesistate to share it with us.

Actually i just emailed the NVC last june this is what thet told me.

Dear Sir,

Your inquiry has been received at the National Visa Center (NVC).

The applicant's name has been placed on the list of documentarily
qualified cases awaiting the availability of visa numbers under the
numerical limitations prescribed by statute. The designated
representative of this case (applicant, petitioner, or attorney) will be
notified of an appointment date as soon as the numbers have been
received. The applicant should NOT make any travel arrangements, sell
property, or give up employment until the US Embassy or Consulate
General has issued a visa.

An immigrant visa is usually valid for six months from the date it is
issued. It may be used to apply for admission into the United States any
time during its validity.

Incidentally, I too made an inquiry last June and given the same response.  However, I think I'll make another inquiry just to know if there would be any changes specially in light of knowing that someone is being asked for their Ds-230 form now.

To further explain why it may be prudent to make another inquiry is to know if there are any changes to their responses.   This way we can anticipate if their might be a forward movement in the Oct. VB or if those already documentarily qualified will be asked to again give an updated ds-230 form.

There was this one blogger in HLG that recently said that he is now being asked by NVC to send in his Ds-230 and accompanying documents.


This is what he posted:

Feb 26,2008------shipped to NVC
august 9,2008----visa processing
fee bill
august 17,2009---NVC instruction packet,required to return ds-230 together with police clearence & the paper with the barcode...my nvc case no. starts with LND...my agency is base in london


From the data he had posted, the only hing I can deduce is that this is the first time he is being asked to send his Ds-230 forms.  Anyway, from past years it doesn't really matter if it were the first time or the 2nd, 3rd time NVC will ask for their updated Ds-230 forms and police clearances since NVC follow the PD and it's proximity to being current to start processing a case.

So, if he is being asked already by NVC for his Ds-230 form, then it would mean that his PD is being anticipated  to be current within 9-12 months of the cut-off date.

Of course, we would not know if he is just the exemption or there really is an anticipated forward movement possibly in the Oct. VB and the next VBs until the Oct. VB is published. 

I also do not buy that him being a naturalized British Citizen has anything to do with it.   The cut-off dates for EB3 ROW of w/c UK is in and EB3 Phils. have been the same for the last couple of years and as of the moment both are still unavailable.  No way knowing as of the moment if the cut-off dates of EB3 ROW has diverged from EB3 Phils.  So, I disagree that him being a UK national has anything to do with it.  For now. 

And from the timeline he posted, it is no diff. from other applicants from the Philippines or any country under ROW.  In fact, his case has even lagged.   

Anyway, I feel the only way we can know if this is a fluke or an exemption is that we make new inquiries and share any differences on NVC's response.

Hopefully, we can spot a possible new trend or at the very least spot new changes on how they do things now.

I have just received an unconfirmed report from a fellow nurse that her friend back in the Philippines with a PD of 2005 ( Didn't mention the month in particular)  is already having a consular interview schedule this coming october 2009.  Whether this statement is authentic or plainly hearsays, still ought for us to find out.
 
Sometimes the NVC auto voice response system is left unupdated and does not coincide with what is actually taking place.  Wise idea is to communicate with your immigration lawyer at this point.
 
Please share with us if there will be any latest developments with your case in the coming days.

Wow, good news !!

If this is true, then it collaborates with the person with an Oct. 31, 2006 PD in the UK getting an e-mail from NVC to send them his Ds-230 form already.  angel

Also means that the possible cut-off date for EB3 ROW and EB3 Phils. will be somewhere in the late 2005 date in the Oct. 2009 VB as NVC traditionally only process a case w/c have a PD close to about 12 months from his date being current.

Now, if only we know the exact month we could make a reliable prediction on what might be the cut-off date in the Oct. 2009 VB. monkey

August and or September 2005 is my personal prediction for EB3 WW and Philippines cut-off date come October 2009 Visa Bulletin. 
 
I am still trying to get in touch again with the nurse who gave me the news this morning. Any further details will surely be posted here soon.

Hi there Fellow Hopefuls,

     Hi T-Cell, Nursidol, Tabaching dj and yang... Miss you guys! Its been a long while since i last keep in touch with you here for personal reasons.  These people that i especially mentioned know why.  Of course, this forum will always be and will remain my only family!  Anyway,  i also want to share my status updates with you all.  And its for you guys and gals to assess what we should expect on the next fiscal year.  I called up NVC this evening to check my case and had the chance to talk with the NVC agent as well to clarify some issues regarding our status.  Here's what have transpired. 

The voice prompt said that my case is still documentarily qualified and case complete since last June 21, 2008 and if i didn't hear or receive my packet 4 from them after 8 weeks i will contact them again. ( nothing had change since last year)
Then I continued talking to an NVC agent thereafter.  I first clarified to her that based on the voice prompt my case status is the same. The agent first told me that if in case my packet 4 is ready once pd is in current state then what the NVC will do is that they will send an email or they will call me.  So the agent checked with me if my email address and my contact numbers are still the same.  And I said yes.  She told me that this is their way of informing the beneficiaries now. So I asked here if there will be movement by October.  She answered back that there will be movement and definitely it won't be a big "U" anymore for EB3 but she cannot figured out what will be the movement or if there will be a huge jump.   Because they have no update from uscis yet.  Then my next question was this.  Do i need to renew or update my documents that are already expired since it was submitted last year and do i need to send it to NVC again?  Her reply is this: You don't need to resubmit another set of documents anymore here at NVC since you're already documentarily qualified last June. 2008.  You're case here is now final and complete that's why they forwarded it here in the Philippines already.  And if ever some of your papers are expired,  the U.S Embassy in your country will be or might be the one to ask for it and you will show it there in the embassy.  She also said that sometimes the embassy doesn't require it anymore.  But to avoid delays she adviced me to be sure of it.  So, she told me renew any expired documents
that I have right now.  And she informed me that my case is no longer at NVC.  And that it was pending here at the embassy since I was docs qualified last year because the visa had all been used up before my pd had been reach. So there goes the retro... But she said they're only waiting for my pd to be current then they will send my visa number and appointment date at the embassy right away.  She told me that they still dont have an idea if my pd will be included so we have to wait for the next vb i guess.  She also informed me that sometimes there's an appointment date already once the pd is current but the packet 4 is receive on a later day on than the scheduled time.  So she said better to check it or call the embassy or NVC as soon as my PD is current.

FYI: 
Pd:  September 2005
Case Status:  Documentarily qualified for the 3rd time last June 21, 2008
Present Status:  Waiting for my Packet 4 still...


      There goes my conversation with the NVC agent my dear fellow nurses.  I dont really know what to anticipate after this infos that i found out.  But I really really hope that behind all of this worst scenarios that we have been through and predictions i know there's still a great silver lining at the end of it all!!! God always do things that is unpredictable and makes impossible things possible.  Hope some of you can react, give their insights, comments about what the NVC agent told me.  At least we could have an idea from it what to expect least!   Again... Expect for the worst but always and hope for the best!  God Bless us all fellow nurse...

I called up the NVC just a minute ago and had the chance to talk with a very accomodating lady. Again I would like to say that I have a PD of August 2005 and that my documents has been forwarded already in Riyadh US embassy since 2008.  But since the NVC Visa Office is the one issuing a visa number to all the applicants, I have decided to ring them.

Same like Cutienurse, the lady asked for my contact number and my email address. Actually they have my contact details already and the lady was just checking if those are still the contact details that I am using.  She then told me that the once a visa number is made available for my case, they will email me the appointment details.  This is something new as traditionally, packet four is being sent through a standard ground mail.

On that appointment letter, there is a list of documents that you have to bring with you at  the embassy during your interview day. So those applicants with documents that are still at the NVC level, this confirms the fact that there is really no need anymore to update your expired documents at the NVC level.

Now regarding cut-off date movements, there will be some parties in the coming months for nurses with PDs of 2005-2006.  The lady didn't exactly told me these words, but with the way shes talks, I can sense what shall happen in the coming months. I hope my senses are working right.

From all the reports (confirmed and unconfirmed) I have been reading, I have a feeling that majority of those with 2005 PDs will soon get their interview appointments.  I hope those with 2006 PDs will also be included if not in the Oct. VB, in the next VBs.  Cross-fingers and knock on wood. angel

We are just in time for the 2nd wave of the swine flu in the US. Joke. devil

Yep, I think the line is getting shorter every year, so I'm hoping for a jump this first quarter. Well, we will know how it will start in about a couple of weeks. Here we go again guys, the start of the new fiscal year.grin

I also believe that there are less numbers of nurse applicants from the Philippines with a PD earlier than March 2003 even if we are to include those who are under the AOS route.

And so I personally think that the cut-off date for the first month of the fiscal year 2009 wouldn't be at March 2003. Contrary to what the visa officer Mr. Oppeheim earlier said.  

Tcell may have been right when he said Majority of the applicants with 2005 PDs will have their interview appointment soon. A prediction that is based from what we are reading lately.

Anyone here with 2007 PDs and is now being asked by NVC for the first time to send in their Ds-230 forms and police clearance ? 

I think we can deduce some more on the possible cut-off dates in the Oct. VB if we have info on that.

Hello guys!

Hi t-cell! its been awhile i did not post from here, but surely Im just here around the corner thinking of what life can bring me if this US will open...
A blogger from hammond law group had just said that NVC emailed her to send NBI clearance and that barcoded thing, her PD is of June 2006.
In regards with this, well Im hoping that we are going to see a light under a long dark tunnel ,afterall this years of waiting....

 Yes  ..The automated response did not change. and when I talked with the agent she said that there is no need to pass another set of documents again and the agent told me just to wait for priority dates to be current which she thinks will move in the next few months.No mention whether my case is already in the embassy.
Tcell ,I do hope your prediction will eventually come true...in the vey near future !!
