If you do not know your NVC case #, pls. contact your agency and/or lawyer in-charge.

You can also request NVC to send it to you, if that will be your first time in e-mailing them.  However, you must instead furnish them your USCIS file # for them to check your records.  Afterwhich, all succedding e-mails to NVC should have the NVC case # on the e-mail subject header and other data needed on the body of the e-mail.

An I-140 that was submitted/filed are automatically given a USCIS file # at once.  That is the only evidence that an I-140 was filed on your behalf by an agency and/or lawyer.

Those who did Adjustment of Status (AOS) in the U.S. only need to go to the USCIS website as everything is handled by USCIS and all fees were already paid from the very beginning unlike consular processing where it is a step-by-step process and the fees are broken up as well from USCIS->NVC->U.S. Embassy/consulate.

dear sir,
greetings! i have a qustion regarding when do i supposed to recieved and fill out my ds 230 form,my priority date is oct 06,my case was appoved jan 07.iam just confuse bec most of my friens who applied via an agency have already submitted their ds 230 form, my application is tru direct hiring, i have a lawyer,but my sis who's in california have contact to the lawyers office,i e-mailed nvc and told me to asked my lawyer, so what i did i asked my sis to contact my lawyer and the answer was just to wait.as far as i know i havent fill up a ds230 form.. and if may i ask what is documemtarily accepted or approve ,iam lost and confuse..

I happen to know some people with the same PD as yours and co-incidentally was approved in Jan. 2007 as well. 

Your case was definitely under Texas SC since it was very similar to a few people I know. Impossible if it were under Nebraska SC because even back then NSC is taking around 8-15 months for approving I-140s and TSC (at that time) are still approving I-140s within 2-3 months, even w/o premium processing.
 
They definitely have received their Ds-230 forms and even re-submitted it at least twice since NVC usually asks for updated DS-230 forms and the approproriate supporting documents.

The advice given to you by the NVC personnel was the right advice because they do not want any shortcomings be pointed to them w/c is the easy way to do, nowadays.

To give you an idea, with your PD and date of approval, you should have gotten the first DS-230 form in July/Aug. 2007 when everything went 'current' and the 2nd request to give an updated Ds-230 and supporting documents around May-June-July 2008.  Why you haven't gotten at least one is, unfortunately, have to be asked to your lawyer. 

How about the visa fee bill?  Do you know for a fact that it was paid for already and on time ??  Right now, that is what is on the top of my head on why you haven't have the Ds-230 form yet.  With your PD, the visa fee bill request was supposed to have been mailed to your lawyer around July 2007 and if your lawyer have not paid that during that time, the 2nd request should have been mailed again last May/June/July 2008. NVC will only ask and accept the Ds-230 forms if the visa fee bill has been paid.  They then send a bar code to be re-submitted with a filled-up DS-230 form (the form can actually be downloaded in the Dept. of State's website but is useless w/o the barcode that signifies a paid visa fee bill).

Documentarily qualified means the NVC has reviewed your Ds-230 form and supporting documents and is complete.  If it so happens, there are visas available, it is supposed to go to a US embassy or consulate.  If there are no visas available, NVC usually keeps it with them until there are visas available.  And depending on how long they have kept your documents or if they will have new policies, they may choose to make another request for the client to re-send an updated DS-230 form and re-send any expired supporting documents.  They will review then it again and label it as 'documentarily qualified' again.  This is why you may have read from diff. sites that some were already 'documentarily qualified' for the nth time.

Though it may cost you a little, the fastest and quickest way for you to contact NVC is by calling them through phone. An automated recorded message system is available 24 hours a day, 7 days a week.

Contact Number: 0-01-603-334-0700. It is imperative that you use a touch-tone telephone since you have to press numbers to link you with proper instructions.

Live operator assistance are only available from 7:30am to 12:30 am (EST).

Before calling the NVC, you have to ready your CIS receipt number. And if you wish to talk to an agent, be prepare for the ff details:

1.) Name and date of birth of Beneficiary and;
2.) Name of petitioning company.

Hello....everyone...
I have a very big problem that i do not how to deal with....My problem is that i do not know my NVC case number.....The reason is that my agent do not want to tell me...it is really weird and bizzard....Sometimes, i guess that my agent does not send my petition to  the US immigration........
...so how can i get my NVC case number without their help?

Do you at least know your USCIS file number?  You can ask NVC directly for your NVC case number but instead provide them with your USCIS file no. as a reference.  NVC will the provide you with your NVC case number. Call them up if you want to talk to someone and to ask for additional advice.  Just make sure you are aware of the time difference.
 
Everyone who has their I-140 (job petition) filed, automatically gets a USCIS number.  There is no excuse for not having a USCIS number.  However, some agencies do not disclose their client's USCIS numbers as well.  Ask them for at least your USCIS case number. 
Remember, everyone has at least a USCIS file no.  No USCIS file no. = no I-140 has been filed. 
 
No NVC case number also means NVC has not received anything yet from USCIS as USCIS automatically sends a notice to NVC once an I-140 has been approved.  No NVC number = No approved I-140 (USCIS)

Hello T-cell...
I know your meaning and thanks for answer, so i can understand more about the procedure of the immigration....
However, my agent went bankrupt last month and i cannot get my USCIS file number  or NVC case number and priority date from them.....which is a big nightmare for me...

In addition,  i was busy preparing for my IELTS exam and i did not follow the result and pregress of my green card petition...Now, I passed the IELTS exam, but my agent went bankrupt last month.....
I at least should  know my USCIS number, but i do not.....crying
Only thing i can do is to send an email to NVC and ask them about my my USCIS file number  or NVC case number .........
Are there any thing i can do for getting my my USCIS file number  or NVC case number ?

My advice for you is to go directly with your agency/employer and ask them directly if they indeed filed something for you.  Ask them directly and request them to give you a point-blank answer whether they were able to at least file the I-140 (job petition) on your behalf.
 
This is impt. because even though they went bankrupt, there might be a way for you to keep your Priority Date (PD), so that when you look for another agency/petitioner/employer you can keep your original PD.Able to keep your PD is impt. as even though you will look for another
 
There is is absolutely no reason why they can't give you your USCIS number if they have filed your I-140 regardless if they went bankrupt later on.  It's either they did or did not file anything and if they did, a USCIS number is immediately and automatically given upon receipt of the I-140.  
  
If they cannot provide you at least a USCIS number, presume that they did not file anything at all as the USCIS number is automatically given by USCIS once they received the I-140.  This is what you need to ask to your former agency.
   
Your former agency is already bankrupt.  No reason not to look for another.  One thing left to do is to try and salvage anything from your former agency, like asking for your USCIS number.  Ask them to be honest to you.
If they did not file anything for you, there is no reason to even contact USCIS as they will not be able to look for any record of your case.  However, if you want to contact them, you can go to www.uscis.gov
You can also try contacting NVC (info. is located on the first few posts of this thread) just in case but w/o you knowing at least your USCIS # and other pertinent info. such as the name of your actual employer/petitioner (in majority of cases, the name of your employer/petitioner) is not one's agency.

Can i keep my original petition and priority date if it is ok, so i can get the green card and work in the US ASAP?

How do you think?

That is why you need to find out from your original petitioner if they indeed filed something for you.  Did you ask them that and can they give you proof that they did?   Since they are bankrupt now, there should be no problem if they provide you your USCIS # or any evidence that they filed your I-140.
 
If they are still unwilling to give some sort of evidence (preferably the USCIS #) it is safe to presume that they did not file anything for you.  You also cannot have a PD w/o a USCIS number.
 
Tell them you need the USCIS # so that you can verify it with USCIS. 
 
If I may be straight-forward to you, I personally think they did not do anything for you base on what you have said and base on their unwillingness to provide you w/ any evidence of filing an I-140 even after their bankruptcy.  Tell them as well, that since they are going bankrupt and they are unwilling to give you your USCIS number then there should be no problem if you go for another agency or petitioner to petition for you.  Tell them that since there is no evidence that something has filed, then you are presuming nothing has been done for you. 
Re: NVC number, since they said to you that they do not have any records w/ them, it is safe to say w/ certainty that you do not have an approved I-140.  Only applicants w/ approved I-140s  are given NVC #s
and Ds-230 forms are only processed if accompanied by a barcode that NVC sends as proof of having paid the visa fee.
 
I say, go ahead  and look for another petitioner/agency.  Just make sure that this time you have an agreement that they give you your USCIS number as proof of filing something for you.  If need be, try to negotiate that you'll only sign something or pay something once they give you your USCIS number as proof of filing the I-140 for you and after you verified that the USCIS # is indeed yours and not someone else's.  There were also times when some agencies gives a USCIS # from someone else just to appease the one who is trying to get hers. 
 
Also, to be safe, ask for advice to your new prospective agency/petitioner regarding your history from your previous agency and if there will be any legal detriments of sort.  There should not be, since they went bankcrupt and they could not give you evidence of filing anything for you.

I personally feel that it is absurd for any US agencies out there that are non-transparent with the way they deal with their nurse applicants.  It is not supposed to be, and none of what we are expecting.  I am just wondering why some nurses still decides to join these agencies despite of being warned against getting fooled. Not providing the USCIS number to a beneficiary is something that is fishy.
 
You have stated in your previous post that you have just passed the IELTS. With the way I see it, if it is TRUE that an I-140 has been filed in your behalf, then I believe that your I140 petition has long been pending for approval at the USCIS.  The USCIS cannot approve any I140 petition without providing them a proof that you have passed the required english exam. They will definitely ask for that prior to having your I140 approved.

Answer:
 
You don't know if the petition has really been filed since you have an empty idea if the bankrupt agency really did their part. You don't even have your USCIS number to begin with.

 
You cannot keep your original petition. And you cannot keep something that you are not even certain you are having of.  Just can't be.
 
Your old/first PRIORiTY DATE can  only be recaptured and use in any future I140 filings only and  if your FIRST  I140 petition has been approved.  That is a privilege that USCIS is giving to us.

Answer:  
 
No. It is not possible. Once your petition is cancelled/withdrawed, you have to start from level 1 again. The new petitioner must need to file a new I140 petition and have it approved. You have a new petitioner so definitely a new I140 must be filed again. Now the good news is, you can recapture your old PD and have it carry over in your new petition. But again, old PD can only be recaptured if your first I140 filing has been approved way before the 1st petition has been cancelled/withdrawed.

Hi, my PD is July, 2006 and got a letter from the USCIS thru my agency that it was already forwarded to NVC. When I checked at the NVC, they emailed me that they don't have information regarding my account. My problem is, I don't know how to contact USCIS since my agency is doing nothing. They're just telling me that it was due to retro., that's why i haven't recieve NVC case#. Please enlighten me and share some info on what I should do. Thank you and God Bless........

When did you get the letter?   Was this recent?  Sometimes, NVC doesn't get the info. from USCIS until 2-4 weeks after USCIS approved it.

Have you checked your case on USCIS'  website yourself?  You just have to furnish your USCIS number and they will check your status automatically.

Processing of the I-140 continues whether there is retro or not. The only thing affected by retro is the stage at the NVC level.

Allow some time for your papers to successfully reach the National Visa Center before actually contacting them.

The USCIS forwards approved cases to NVC in bunches as previously explained to me by my Immigration lawyer. It may show via their USCIS online site that your I140 had been approved, and is already forwarded to the NVC, when in fact, it's still with them. So just play safe, wait for approximately 60 days from the date of your I140 approval, then contact the NVC.

NVC is sure when they said "they still dont have your account/file". Because usually, it only takes NVC to create your NVC portfolio and generate a NVC case number, within the first 24hours of it's receival from the USCIS.


Congratulations but since it's still retro, No hurry anyway.

Got my approval Nov. 13, 2006, my agency gave me a copy of that approval letter and i also check my USCIS account.  Yes, it was approved and forwarded to NVC.

How can I contact USCIS, regarding my case? I've been trying to call and text my agency but to no avail no one is answering.

Please help me with my problem! My visa screen will be expiring on Feb., 2010 so I guess I have no choice but to take the exams again. What a waste!!! Time! Money! and Effort!!!!

If you absolutely need to make a more in-dept inquiry you have to make an appointment to them via infopass.

However, from your story it seems that as far as USCIS is concerned they already indicated they have approved and forwarded it to NVC already base on the regular case status check-up on their website.  I would be surprised if they will tell you any different.

Regarding your agency, it's best that you pay them a visit already. No one answering via SMS or landline calls is not a good sign.
