Note : My ex-immigration lawyer told me that my I140 approval date could have
been same as my Priority date if only I was able to take IELTS earlier, secure
and provide my CGFNS certificate to the USCIS. My ex-lawyer filed my
immigrant petition initially with CGFNS passing letter only. That is why
the USCIS issued a RFE way before the petition is approved.
I still believe that this is the main reason why I get caught with this retrogression. Since the date that I got my I140 approved(February 2006) by the USCIS, my application never reached the NVC. Lost in the middle till finally retrogression started last quarter of 2006. Tried making a follow up with USCIS, officer told me that my case has been forwarded to the NVC. Tried contacted NVC late 2006 till early 2007, NVC said they did not received my file from USCIS. Sometimes badluck like this happens. My previous agency also was held helpless and futile. Realizing what I've been through, with the delays and misfortunes brought by less-efficient agency and Immigration lawyer I have, I decided to quit.2nd Petition: Filed through PREMIUM PROCESSING

Wow nurse idol...you've come a long way.We got same streamline of a story.I had my first I-140 filed by my employer 2004.Priority date same year but got a hell of personal issues that I didn't continue pursuing my application.Got a final notice on 2006 that I can still make an appeal of my case provided I will make letterof intent to continue, but put it off and finally asked my agency to cancel it and handed my letter of cancellation.Moving on with my career in Mid East made me felt staying in the same work environ kinda' "stale" with the routinary activities.So went back here in PI doing private practice and rekindled hope to look for a good employer for U.S.Isn't it so ironical when a good chance for me to go to the U.S. I have just given it way???But as they say we live and learn, so I decided to start over.Here are my records:Receipt Date : November 28, 2008

Where we stand right at this point in time is direclty as a result of what we've been through in the past. Yes you are right, take it, and learn from it. If we are really meant to be in US, then God will find a way.
With regards to your 1st petition, I would think that you have cancelled the petition (I-140) prior to its approval. This is the reason why you weren' able to keep your Old Priority Date. But anyhow, so much for that, good luck on your new filing. Let us continue to hope for the best.
With regards to premium processing, It is not the PD that would be premium although it somewhat relates. It is more of the filing route. If your employer/agency filed for I-140 under premium processing, then the process in getting your I-140 processed and approved is speedy (within one to two weeks time) compared to having it filed under the regular route that could take months to process. The USCIS has a special division that solely devotes in working for petitions filed under the PP. It wont have to go to the CIS service centers (e.g Texas SC, Vermont SC) for processing.
You will be able to know what kind of petition filed by merely taking a glance at your Packet 1 or the notice of receipt document. Infos will be shown there like the type of filing made, and wether it's under regular route, or PP route.

The NVC will give a go signal to your lawyer on when to settle your Visa Fee Bill once your case is ready for further processing. Usually the NVC will do this if your Priority date is predicted to become current in nine to twelve months time. After paying the visa fee bill, the NVC will already be asking for your DS230. Submit your DS230, they'll review your file, then if everything is fine, you'll be declared as documentarily qualified.
Once documentarily qualified, all you have to do is wait for your packet 4 ( Consular interview schedule). This will happen once your PD is already current.
Since retrogression is ON, and since the last cut-off date is dated down to March2003 for EB3 category, expect that there'll be no further processing for now with your case granting that your PD is somewhere in 2008. Not unless the October 2009 Visa Bulletin will show up a cut-off date of at least 2007.
Anyway, God is good. God works on miracles. I hope and pray there's a coming solution to this soon. And hoping in due time, we will all be in U S of A.

Hi, thanks for the crystal clear explanation.A follow up querry, granting that PD's moved progressively and if I will be in other country working, will it be OK to request from my petitioner to have the interview in that country? Could this be possible or not ?What if my dependents are in the Phils. and not with me in the foreign country where I am working, should this be one reason that I cannot request interview to any U.S. Consular other than PI?

In the event that the cut-off date advances forward then your PD becomes current, and granting that you are working in another country at that time, YES you can certainly request for a change in consular post. Your petitioner has nothing to do with it. You wont request this from your petitioner, instead, from the NVC. Your immigration lawyer will have to write a letter addressed to NVC requesting for a change in consular post. I think there should be a substantial reason why such request is made so that the NVC will approve the needful.
Now with dependents, I think it is still lpossible that you can have the consular interview separately. So long as it is supported with documents. You might as well consult this to your lawyer. But personally I would say, it seems to be a hassle and uncomfortable, better yet have the consular interview altogether as one family to avoid complications.
Note that my first consular post is Manila, Philippines but because I've been in Saudi Arabia since 2005, My lawyer requested NVC to have my consular post here in Riyadh, KSA. That's one of the reasons why I couldn't go away from this place that easy. I wouldn't want to request for another transfer as much as possible. Hehehe
We have a lot of nurses here that are also just waiting for their PDs to be current. But they chose to maintain their consular post in MANILA. You've been in KSA and I assume you know how things works out in here. I say, Saudi Arabia is the easiest way IN, and the quickest way OUT. They'll make they're own tricks in finding their way out once they'll be called for a consular interview in Manila.

Yes there is a possibility for NVC to ask us to update our DS230 and police clearance moreso if they are already more than a year old before NVC gets to touch our files again. We've done this before.
But I hope this wont be the case anymore to avoid hassles. We can do this at the consular level when we are called for the interview instead. Let's wait for the NVC's advise soon as our PD becomes current.

I'm here in the Philippines and the lame part is that Taiwan Embassy here does not issue police clearance ... guyam, although NVC has always asked for updates there would always be a possibility that they may not ask for it again. Until NVC actually asks for updates, don't presume anything yet.
There might even be no DS-230 form anymore. Word is it will soon be replaced by the DS-260 form (on-line form) to make the process cost-efficient.
As far as for your Taiwan police clearance. Since you only worked there from '96-'98 and your Taiwan clearance was only done last year, it is valid and no update is needed since you haven't returned there again. No new information can possibly be included in an updated Taiwan police clearance if you haven't been working and living there since 1998. That Taiwan police report you have done last year already covers your stay from 1996-1998.
The only police clearance that needs to constantly updated is in the country where one is currently working and living.
Hope, that clears things up a bit for you. Wait for nurseidol for his opinion.
P.S. I'll update the thread I previously made regarding the new DS-260 on-line form. A 30-day public comment period (this is done before they implement new procedures) was already done in mid-May and there were no complaints meaning it will soon be implemented.

NVC do not process cases until the priority date is within 9-12 months of the cut-off date.
Since the cut-off dates has been unavailable for a couple of months and will be that way until the Oct. VB, they will not do anything with your case.

Tcell is absolutely right. Do not expect for any progress to happen now since there's ZERO visa available for us. And also, NVC will not notify you regarding the need to update your files IF there is still a need, till your PRIORITY DATE is 9 to 12 months from the actual cut-off date.
No need to worry at this stage and as what t-cell have said, there's also a possibility that we wont utilize this DS230 anymore, DS260 is the new and advanced form in replace of the paper-based DS230.

I agree with what Tcell have said. The only POLICE CLEARANCE that you have to update is the Philippine police clearance. No need to obtain new one from Taiwan since you've been out of that country already. The Taiwan police clearance that you have obtained and submitted to NVC last year is more than enough.
