Bec it will cause a major setback or delay, like for her case pd is 2006 which is very possible to have her packet 4 if the visa bulletin move forward.And even though your pd will be current and the Nvc is not yet thru with your case lets say you change status, Nvc can not send the packet 4 to manila immediately coz you just give them work to review your case again and thats the Recruitment specialist is pointing to her.

Its not based on luck but its a practise common to the Manila consulate/embassy as long as you dont submit fraudulent paper like marriage contract, sure the consul will verify that during personal interview.

I pretty much understand how these things work.
The USCIS is responsible for approving immigrant petitions beforehand. Once approved, the case will be forwarded to the NVC for further review and processing. It is at the NVC level that you will be asked to submit the DS230, which is the actual Immigrant application form. Since it is at this point that you will actually apply for an immigrant visa, it is imperative that you have to declare your latest civil status and or biographic datas as honest as possible. It is advisable to declare your change of status at this point rather than to submit a partially non-truthful DS230.
A DS230 that is not filled based on full declaration of truthful infos is none but a fraudulent paper itself. So how could one make the consul believe that any other succeeding docs submitted by him, bears the truth when in the first place, he already submitted a partially non-truthful DS230? Again, declaring that one is single, when in fact he's not, is still possible to be questioned by the consul.
On the other hand, I understand the point of the agency. There shouldn't be any delays that is why they are considering this idea. I also agree with Snipee and with everybody in here that there will be for sure, a lenghty delay once PINAYNURSE will decide to declare her husband in the DS230 as her derivative.
It may not be based on luck, but I am sorry as it may not also be a common practice in Manila US embassy as you are the first and the only one that I or we have known to have undergone a process like this. I congratulate you and I am very happy to have learned that this can also happen.

Way back 2005-2006, when nurses and physical therapists are on schedule A and VB shows "C", there were some cases same as Snipee. I can vouch to that as my cousin, seniors and some of my Clinical Instructors have succeeded in obtaining immigrant visas for their husbands/wives eventhough thay have not declared them in the DS230. But note as well that majority of them got married just after the NVC declared them as documentarily qualified. The processing of cases those days was so fast, that they were no longer asked to update their ds230 but instead, have just brought their betterhalf with them at the time of consular interview.
Things are changing drastically, the process may not be like before since at present we under EB3 and is now trapped with visa retrogression. I haven't heard stories alike what had happened to my cousin and acquaintaces before, not until recently, SNIPEE did same and ended up successful.
I am not in any way raising an argument in here. I am just stating my opinions and ideas based on what I've known all this time. I may be wrong, while others may be right. But in any way, I am very happy for any success of any kind that our fellow members had achieved.

I personally wouldn't want to assure anyone in here that spouse/s can be added as derivative/s at the time of consular interview. Sorry, although there are some cases that ended up successful through this way, I still see some gltiches on it.
It requires one to fill-up the DS230 as honest as possible. Declaring that you are single in the DS230, though you're not, then all of a sudden will try your luck to present your husband before the consul at the time of interview is obviously an act of fraudulence. If a GOOD and KIND consul will be with you, then LUCKY you, your case may be consider. But what if it will be the other way around? Then you'll gonna waste everything.
This is just a friendly advice. Call it consular processing or whatsoever, the point is, It pays to be truthful especially when it concerns legal matters.

As far as I can remember I just signed my 2nd DS230. I am not the one who filled-it out but my recruitment specialist bec. they want it type written. Whatever what was written on my first DS230 was the same info in my 2nd DS230. I trusted my RS with what she said because I believe she's knowledgeable with the process than I am.
I don't have any intention of being dishonest actually I am always reminding her when will I give the papers of my husband and she told me just be ready for it because I will be submitting it during the interview as well as the fee bill.
I hope that I will overcome this.

Just to add up,
1.) How many times did NVC asked to update your DS230?
2.) Did you get married after NVC declared you as doc qualified?
3.) Any idea what is the reason behind the delays in visa issuance? Is there something to do with case pending due to administrative processing? Suspect that this MAY BE a possible reason as issuance of visa to a spouse that is declared as a derivative ONLY during the interview is not normally being done, so your case is subject to further review.
We are looking forward for answers.

Hello guys. Snipee had some sort of a delay in getting their visa, but it was not related to him having sucessfully declare his spouse during the interview. In fact, everything went smoothly, according to him. (when I asked him) Anyway, I'm sure he'll tell his story once he gets his visa.

When was the date NVC declared you as doc qualified? From what we know, and according to NVC agents recently, there is no need to update the DS230 and other docs once an applicant is already doc qualified. Pesronally, I don't see any logic for the need to update our docs at the NVC when it can be easily done at the consular level during our interview. I hope NVC is now aware of the hassles of updating ds230s can cause to both parties(NVC and applicants).
The scenario you presented is worry-free and Cutienurse can best explain why.

At the st lukes clinic, there are hundreds of people having thier medical, im out about 7 pm, and need to go back for another test the next working day, afte that i give my passport to the US counter and they wil be the one to forward it at the Embassy for the issuance of the visa, as per instruction by the filipino employee at the embassy.For my wife she needs additional test and a setback of "10 weeks happened,plus the holidays total of 12 weeks, she was done with her medical January 8,'09 and also leave the passport at the US counter to forward it to the embassy.
On Jan 20, I called the Embassy hotline re my case status,Lady filipina told me that it was already with the Consul officer this Jan 16.
Then Jan.22 a US embassy employee called me, asking for additional surcharge of $45, bec before visa fee is only $355. For my wife no need bec i payed $400 at the time of interview.
Jan 23 I went to the Embassy about 11:30 am, payed the surcharge $45,then at the visa pick up counter the Embassy employee show me the 2 passports with visa telling us the expiration date and told me if i already pay the courier fee which is now AIR 21, i said i paid Deibros courier, he said thats ok it will be delivered wait for 5 days more or less.
I have a civil wed late 2007, I was declared documentarily qualified last June 2008, having updated my DS230 the last one in MARCH 2008, the other two is wayback 2007 July, the other one i just cant remember.
All my DS230 are the same I didnt change anything. If you would notice i passed my updated ds230 just late march but was declared Doc Qaulified by June.
From experience even your pd is already current for months, the Nvc will not send the packet 4 in manila until they are not finish reviewing your case.
In addition to that, before I have a major setback! need to change my name bec of error in my birth cert wayback 2006 and also change my passport,thats why I was not able to grab the chance when congress release 50,000 visas for RNs @ PT's

It was because you went for medical only after your interview. From what I learned from other posts, applicants usually go for their medical at least a week before the interview eventhough the packet 4 says the schedule is on the same day...this schedule only means that you should be done with your medical by 12 am of your interview day. Your experience will serve as a lesson to us waiting for our packet 4. We should go to our medical a week or better 2 weeks before the interview so that if there are additional tests needed we will have time to complete those tests before the interview to avoid delays in the release of the visa because the embassy will not release the visa until the medical is complete.

I fully agree with APC.
Immigration Medical examination is better done at least a week prior to the interview schedule. Other applicants had it done even two weeks earlier in anticipation that a problem may arise during the medical exam.
Yes it is true as well that the medical exam date and time written on the appointment letter is more of a deadline, rather than an actual date and time of the exam.
Upon receiving the appointment letter (packet 4), my suggestion is to contact right away the SLMC extension clinic and have your booking at least a week or two from your interview date. In the event that the Doctor found out that you are medically unfit and needs to undergo further treatment for weeks/months, The SLMC-ext. will be the one to inform it to the embassy that the interview date must be re-scheduled due to medical problems, and will be the one to coordinate and manage to give you a new Embassy interview schedule right after you have been declared as medically fit for immigration.
In some countries however, medical exam is being done right AFTER the interview. But for majority, It must be than earlier than your scheduled interview.

hi ash" I recieved my packet 4 without the Medical shedule, only the immigrant visa Interview appointment.
But when i checked it to the Manila embassy website,I just type and click my case no. then my schedule of interview pops out together with my Medical appointment, thats where i learned my medical schedule.
And not the usual packet 4, which indicates an interview and medical sched,there are many variations if you'll compared before. Now its like 5 pages, all the documents you submitted have corresponding status and i guess its advantage to us,we will know what documents we lack and will give as time to accomplished it before facing our consular interview.
Usually packt 4 are recieved 1 Month. before your schedule, but in my case i recieved it Monday and the schedule is Friday that very "the same week", i dont have enough preparation.
But if i recieved it earlier i could have arrrange with St. lukes on my early medical.
Because as long as you have your Packet 4 schedule on hard copy, you can show it to St lukes, so early medical is allowed, just show the proof to the Guard on duty.
