Hi everyone. Well, in our case,me and my wife last submitted an updated ds230 last march2008(for the 3rd time), together ofcourse with other docs. At that time, our son was already 1 year old, and he was listed as FTJ(follow to join or accompynying at a later date). This was done by the agency so that our case will not be DELAYED. If we put him as "accompanying now", NVC will have to generate his feebill then fillup another set of ds230 forms, etc. The agency and lawyer told us that his feebill and filling up of his ds230 will be settled during the interview. And at that time, I think we were current for 2 months(cut-off was march2006), so we were hoping to receive our packet4. Unfortunately we didn't. Last Aug2008, we were blessed by another child, and we were again told that her feebill, ds230 forms will be settled during the interview. Just prepare the child's passport, the agency said. So here we are, waiting for the next VB.

I'm not a bit worried since I talked to people with similar experiences. Children can easily be added during the interview,as long as he/she is below 21. Well at least that's what I heard.Smile

hello everyone!!!happy new year ; ) I've been thinking if posting this will inspire or bring confusion to many..but i believe it'll keep our hopes...i have this batchmate with PD of Dec 2005, interviewed by the consul last Nov 7 or 11, received her visa last nov 26 or 27...now leaving for US on jan 21...

Amazing right?yes her PD is dec 2005..I know there would lot of questions but i can't answer them..but its true...God bless us all...Let's keep praying...

i already emailed my petitioner but still no reply, so I decided to prepare ds230 for me and my family. our newborn will be listed as follow-to-join to avoid unnecessary delays... hope this thing works in my case.

Hi joc. I'd like to share also my case. I'm married with one daughter born April 2008. My husband and I submitted our DS230 (both of us filled out Ds230) last May 1, 2008 when my daughter was only 10 days old. My lawyer advised us to put her as following-to-join to avoid any delays. Because if we put her as accompanying us, then we woud have to wait for her visa fee bill, her birth cert and passport which I did not have last May 2008. But since we put her as following to join, then we did not have to pay her visa fee bill and submit her docs at the NVC. We were told that we could just bring her docs and pay for her fee bill at the time of the interview. Just make sure you put the name of your newborn in your DS23O because he/she was already born before you update your DS230 you have to declared him/her in your Ds230 either as acoompanying you or as following to join.

Hi nursing...when your I-140 is already approved by USCIS, they will send your file to NVC who will create an NVC case number for you. Your file will stay there until your priority date becomes current. Then when your PD becomes current in the monthly visa bulletin, NVC will send your lawyer your visa fee bill(will be paid either by your employer or you depending on your contract with the employer). Once the NVC receives the payment of the fee bill, they will send your packet 3 (which is the DS230 form). You wil fill this up and sign it and return it together with your documents(NBI clearance, photos, birth cert, marriage contract, copy of passport). Once NVC receives your DS230 and documents they will review it to make sure no documents are missing. If everything is complete they will declare you documentarily qualified and if your PD stays current you will just have to wait for your interview schedule(packet 4).

If you are married make sure to inform your lawyer so your husband and children will also be sent visa fee bills and NVC can process all of you at the same time.

I spoke to my agency yeterday regarding Visa buletin and they reckon there will be no significent movement for EB3 till April buletin, they say 50% of yearly visas were used up in the first quarter and that the rest will start getting released in April

Hi Apc, how will i knoow if i am doc qualified? whom will i ask the lawyer in my agency or the NVC?
my pd is 2007 based on your experience when will i be doc qualified?

Hi i just registered now but I have been reading your post here for quite some time.
I just want to get your opinion with my questions. When I applied for an EB3 visa I am still single but now I am already married but still my agency told me to update my status during the embassy interview.
 I am documentarily qualified twice and up to now my petition is still single. Is it ok to declare my status only during the interview? I am worried because I don't want my husband to be left here. By the way my PD is July 2006.

Hi, nursing.  You may choose either or do both.  I always recommend contacting NVC directly.
You can go to our General Foreign Nurses Discussion category and look for the sticky thread 'Contacting the National Visa Center'.  You can choose to either contact them thru phone or e-mail.  If you are not in a rush and there's no rush now since most cases aren't current now, I would just recommend e-mailing them.
For details on how to do it, pls. refer to that thread.

Hello pinaynurse. I think you should inform NVC that you got married so that his feebill could be settled, along with the DS230, when NVC asks for it. Babies and children can be added during the interview, I'm not so sure about spouses. Anyway, correct me if I'm wrong here guys.
Or better yet seek professional advice. Talk to your lawyer or your agency's lawyer about it.
Just my humble opinion, you can ask other members from this forum and hear what they have to say.

Hi pinaynurse1723 and welcome to the forum.  smile

I don't think it is that easy to just add your spouse during the interview and for what I know only newborns can be easily be added. The consul may also interpret such things as being dishonest because remember, when you were filling up the Ds-230 form, you have signed there that you have given them accurate answers.

They may also suspect you of something else if you try to do that. They will check your marriage and cross-reference the alleged date of marriage and the time you signed the previous Ds-230 forms and answered there as being single/unmarried. 

Wait for answers from others as well.  I'm sure they can give more insights into your problem.

 Hi there pinaynurse1723,

     First & foremost welcome to our family here at lefora.  Anyway, with regards to your status.  I have a few questions before i could further share my knowledge.  First,  When did you get married exactly?  Is it after your petition was appoved or before USCIS forward your I- 140 to NVC?  Or you just married recently? Please confirm to me the details so that we could know the exact answer for your present status.  Maybe i could be of big help for i was also single when the time my employer petition me but i was able to include my husband to go with me at the same time if in case will get the chance to have the visa soon.  And i was able to put him as my dependent when i submitted our DS forms at nvc as per advised by my lawyer and instructed by NVc itself.  FYI, I got married after my petition was approved then afterwards USCIS forwarded my case to NVC as well, and before i submitted my packet 3 including the DS Forms and visa fee bill.  Hope to hear some more clarifications from you soon...
